1. General Provisions
1.1. This document is an official offer (Public Offer) by aiTeacher LLP (hereinafter — Provider) to any individual or legal entity (hereinafter — User). 1.2. Use of the Platform implies full and unconditional acceptance of the terms of this Offer. 1.3. Acceptance of the Offer is registration on the Platform or making a payment (buying credits). From this moment, the agreement is considered concluded.
2. Terms and Definitions
Platform — the aiteacher.kz web resource providing AI services for automated work checking, material generation, and analytics. AI Analysis — the process of data processing (texts, scans, tests) by artificial intelligence to assess knowledge and form recommendations. Credit — the internal unit of account (digital asset) of the Platform used to pay for a specific volume of AI work. Balance — the User's personal account on the Platform, which displays the amount of available Credits. Scan Processing — functionality for recognizing images and handwritten text for subsequent AI analysis.
3. Subject of the Offer
3.1. The Provider gives the User access to the Platform for: Automated checking of essays, tests, and creative works; Digitization of paper works via scans/photos; Obtaining personalized analytics on students; Generating educational materials. 3.2. Access to services is provided on a "Pay-as-you-go" model through the deduction of Credits.
4. Credits and Service Procedure
4.1. To activate AI analysis functions, the User purchases credit packages. 4.2. The cost of one request (checking one work, recognizing one scan) in Credits is set by the Provider and displayed in the Platform interface before performing the action. 4.3. Credit Validity Period: Purchased Credits have no expiration date and remain on the balance until fully consumed, subject to account activity. 4.4. Credit deduction occurs at the moment the User confirms the command to start AI processing.
5. Payment and Refund Procedure
5.1. Payment Acceptance: Payment is made in tenge through integrated payment systems (bank cards, QR payments). For legal entities, payment via invoice based on an additional agreement is possible. 5.2. Refund Policy: In accordance with Article 35 of the Law of the Republic of Kazakhstan "On Consumer Protection," the User has the right to refuse the service before its actual provision. Refund for unused Credits: The User can request a refund for Credits that remained on the balance and were not consumed. Retention: Upon refund, the Provider is entitled to retain actually incurred costs (payment system commissions for transfer and payment processing). Used Credits: Funds for AI generations and analyses already performed are non-refundable, as the service is considered provided at the moment the AI processing result is delivered. 5.3. To process a refund, the User sends an application to support service at: admin@aiteacher.kz. Review period — up to 10 working days.
6. AI Usage Specifics and Liability
6.1. AI Accuracy: The User understands that AI is an auxiliary tool. The Provider does not guarantee 100% assessment accuracy and recommends the teacher perform final verification of results, especially in controversial cases. 6.2. Scan Quality: Text recognition quality directly depends on the clarity of the uploaded image. The Provider is not responsible for AI errors caused by poor quality source data. 6.3. Personal Data: When uploading student works, the User undertakes to comply with the Law of the Republic of Kazakhstan "On Personal Data and their Protection," including not transferring data to the AI that allows unambiguous identification of a child's identity without the consent of legal representatives (it is recommended to use depersonalized lists).
7. Rights and Obligations of the Parties
7.1. The Provider is obliged to: Ensure system operability and safety of the Credit balance. 7.2. The User is obliged to: Not use the Platform to create content that violates the legislation of the Republic of Kazakhstan or ethical norms of pedagogy. 7.3. Intellectual Property: AI algorithms are the property of the Provider. Analysis results and generated documents belong to the User.
8. Final Provisions
8.1. The Provider has the right to change the terms of the Offer and the cost of Credits, notifying about this through the Platform 5 days before the changes. 8.2. All disputes are resolved through negotiations in a pre-trial procedure. The place for considering disputes is the court at the location of the Provider in the Republic of Kazakhstan.
